The appellant, Eugene Milton Clemons II, was charged with two counts of murder made capital because the victim was a law enforcement officer who was killed in the line of duty and the murder occurred during the course of a robbery. See Â§Â§ 13A-5-40 (a)(5) and 13A-5-40 (a)(2), Code of Alabama 1975. The appellant was convicted of the capital offense of murder during the course of a robbery. Â§ 13A-5-40 (a)(2). The jury unanimously recommended that the appellant be sentenced to death. The trial court accepted the jurys recommendation and sentenced the appellant to death by electrocution.
